摘要
先秦的"德治"与"法治"之争,实质是社会治理方式之争。儒家具有由来已久的重德传统,同时认为法和刑也是调节社会关系、维持社会秩序的重要手段。儒家"德治"中"君德"的思想非常丰富,"以德治君"体现了儒家思想的批判性品格。在中国建设法治国家、推进法治进程的今天,更应该关注德治,关注制度下人的因素,关注道德的人和人的道德,尤其要关注官员群体的职业操守和道德素质对于法治的重要性,而不应摒弃德治,患上制度迷恋症。
The debate about"virtue-governing"and "law-governing"in the Pre-Qin period,is the debate about social governance mode,essentially.Confucianists has a long history of tradition of taking morality seriously,at the same time,think that the law and the punishment are the important means of adjusting social relations and maintaining social order.The idea of"the sovereign's virtue"is very rich in Confucian"virtue-governing"thought,and the thought of"restraining monarch by morality"embodies the critical character of Confucianism.Today,during the construction of law-governing country and the advance of law-governing process in China,we should pay more attention to virtue-governing,human factor under the system,moral man and man's morality,especially must pay attention to the professional ethics and moral quality of officials groups for the importance of law-governing,and shouldn't abandon virtue-governing,obsess system.
