摘要
近年来,随着工伤保险的日益普及,人们对维护自身权益的诉求也相应增强,但由于目前的法规效力不高、劳动关系难确认、认定标准不灵活、监管服务跟不上等原因,发生在工伤保险领域的争议不断增多,涵盖了参保缴费、工伤认定、伤情鉴定、待遇核算与支付等各个环节。因此,需要从明确职责、提高立法层级、细化实施办法、提高人员素质、建立多方协管等方面着力,在全社会形成齐抓共管的局面,确保工伤保险得到有效落实,全力化解因此而产生的各类争议。
With gradual popularization of employment injury insurance in recent years, claims for safeguarding one’s own rights and interests have been increased. Due to reasons such as legal effect being low, labor relationship hard to confirm, identification standard inflexible, and supervision service backward, disputes in the field of employment injury insurance is increasing, covering all links like payment for enrolling, injury identification, treatment accounting and payment. Therefore, efforts should be made in clearing responsibilities, elevating legislative hierarchy, refining implementation methods, improving personnel quality and building multiparty assistance in management, to make sure that employment injury insurance is effectively applied and all kinds of disputes are resolved.
