摘要
土地租佃关系是指由拥有土地的地(田)主将土地出租给佃户耕种,并以一定方式和一定比例向佃耕者收取地租而形成的地主与佃户之间的权利责任和义务关系。租佃关系是明清社会中一种主要的生产关系。本文从明清租佃关系的类型划分和演变发展历程入手,对明清时期土地租佃契约种类及其国家对租佃关系立法调整进行了较为系统地论述。
Land tenant relation is the relationships between landlord and tenants,which is also a relationship of responsibilities and obligations. It is the major production relations in the Ming and Qing dynasties. Based on the classification and evolution history of the tenant relations in the Ming and Qing dynasties,this present paper systematically discussed the land tenancy contract types and their national legislation.
