摘要
情节在案件事实与证据之间起到很好的中介作用,狭义的量刑情节证据是反映犯罪人主观恶性程度和犯罪行为前后情况的事实材料。廓清行为事实与行为人因素基本界线,对侦查取证工作及后续的诉讼活动均有实践指导意义。侦查取证应当遵循以事实为根据、客观全面、主动取证、自由证明的基本规则。量刑情节的侦查取证工作思路:在取证渠道上主要围绕犯罪嫌疑人展开;在取证内容上相对精细化;在取证方法上注意引导案件当事人与法律合作;在侦查终结阶段重视量刑情节证据的移送工作;在起诉审判阶段积极配合公诉机关补充量刑情节证据,必要时侦查人员出庭作证;在未成年人案件中建立与司法部门的常规沟通机制。
Plot is a great intermediation between case fact and evidence. Narrative sentencing plot evi- dence is the factual material to reflect the criminal＇ s subjective degree of malice and situation before and after the crime. It is of practical and directive importance for collecting investigative evidence and litigation afterwards to outline the behavioral facts and factor of the doer. Collecting investigative evidence of sentencing plot should follow the basic rule of rooting on the facts, being subjective, taking the initiative to obtain evidence and free proof. Collecting investigative evidence of sentencing plot shall abide by the following principles ： 1. mainly focus on the criminal on the ways of evidence collection; 2. be elaborate on the content of evidence collection ; 3. try to lead the case litigant to cooperate with the laws on the methods of evidence collection ; 4. on the final phase of investigation, pay attention to transferring sentencing plot evidence; 5. in the phase of sentencing, coordinate with prosecutors to add plot evidence, 6. bring investigators before the court for testimony, if necessary; 7. when dealing with cases involving adolescents, try to establish the communication mechanism with the justice department.
