摘要
在分析我国近20年来排污权流转试点存在问题的基础上,运用了历史分析、逻辑分析等实证分析方法,探讨了我国排污权流转的理论依据,即以生态补偿理论及财产权理论为基石,明确了排污权的用益物权属性,进一步研究了我国现阶段排污权流转的困境,提出了构建以初始有偿分配为上层制度,排污权流转为中层制度,法律保障为下层制度的三层次排污权流转制度体系。
Based on the analysis of existent problems in the emission right transference experiments in China in recent 20 years, the author used the methods of empirical analysis methods （ historical analysis and logic analysis） to explore the theoretical foundation of emission right transference, made clear the usufruct attribute of emission right according to ecological compensation theory and property right theory, further studied the dilemmas of emission right transference in our country at present, and put for- ward to construct a three-layer emission right transference system which took initial compensative allocation, emission right transfer- ence, and legal protection as the upper-layer system, middle-layer system, and lower-layer system, respectively.
