摘要
量刑证明与定罪证明同属于以证据为基础的证明活动,在证据属性、证据规则、证明模式、证明标准、证明责任等方面呈现一体同生的遗传因子,共生于证据法学体系中。以"一分为二"的哲学理念探析量刑证明与定罪证明统一与分离的证明关系、严格与自由的证明模式套用之争、标准与差异的证据规则之议、一维与多元的证明责任之疑以及单一与分层的证明标准之惑,有助于明确量刑证明在证据法学体系中的特殊地位,推动量刑证明与定罪证明理论体系的协同发展,促进量刑证明的规范化。
Conviction confirmation and penalty measurement confirmation all belong to confirmation activity on the basis of evidence, they present the contemporaneous genetic factors in the same body in evidence attribute, evidence rule, evidence pattern, evidence standard and evidence liability, which coexist in the system of evidence law. With the philosophical concept of ＂one divides into two＂ to explore the confirmation relationship of the unification and separation of penalty measurement confirmation and conviction confirmation, the argument on the confirmation pattern application of strictness and freedom, the evidence rule discussion of the standard and difference, the confirmation liability suspect of one dimension and multielement, and the confirmation standard confusion of and hierarchy, which is conductive to ensure the special position of penalty measurement confirmation, promote the development of penalty measurement confirmation and the conviction confirmation theory system, and enhance the standardization of penalty measurement confirmation.
