摘要
中国(上海)自由贸易试验区管理委员会(以下简称"自贸区管委会")为上海市政府派出机构,具体落实自贸试验区改革任务,统筹管理和协调自贸区有关行政事务。对自贸区管委会的"派出机构定位",不仅学理上解释不通,在实践中也很难担负综合性行政管理职能的使命,会出现体制机制不顺、责任主体不明、行政效率低下等一系列体制问题。根据相关法律、法规及规章赋予中国(上海)自由贸易试验区管委会的职能将其定位为"派出机关"较为合适,也具有重大的现实意义,也是为自由贸易区行政管理体制改革乃至我国地方行政体制改革提供一种新的思考路径。
China （Shanghai） Pilot Free Trade Zone Administration？ （Hereinafter referred to as FTZ Administrative Committee） is a dispatched institution of Shanghai Municipal Government, specific- ally carrying out the pilot reforms in the PFTZ, and making overall management and coordination of ad- ministrative affairs relating to the PFTZ. Defining it as a ＂dispatched agency＂ is not only untenable in theory, but also increases its difficulty in fulfilling the duties of comprehensive administration in prac- tice, which may lead to a series of structural problems such as handicapped system or regime, blurred responsible entity and inefficient administration. In light of relevant laws, rules and regulations, it is more appropriate to designate the FTZ Administrative Committee as the ＂dispatched agency＂, which will be of great significance in reality and will provide a new insight into the reforms of the FTZ adminis- trative system and local administrative system.
