摘要
在著作权法领域,学术期刊著作权使用保护的特点和内容是各国著作权法的通行制度,但也是著作权实务与理论研究中一个最具争议的问题。我国著作权法虽对此有所规定,但国内相关论述并不多见,该制度尚未引起学者们的足够重视,学界也未形成理论化、系统化的观点。学术期刊著作权使用保护的特点应包括其主体特点、客体特点和学术期刊自身的双重属性。学术期刊著作权使用保护的内容主要包括学术期刊的著作人身权、财产权和专有权。因此,加大对学术期刊著作权使用保护的特点和内容的研究,不仅在著作权法领域具有重要的意义,而且对促进学术期刊的健康发展、保证学术成果及时准确地交流等方面也将产生深远的影响。
In the field of copyright law,the characteristics and contents of the copyright protection of academic journals are the general system in the world; they are also the most controversial issues in the field of copyright practice and theoretical research. Although the copyright law of our country has some provisions,the domestic related discussion is not much,the system has not yet attracted enough attention,and the academic community has not formed a theoretical and systematic theory. The characteristics of the copyright protection of academic journals should include the main characteristics,the object characteristics and its dual attributes. The contents of the copyright protection of academic journals mainly include the personal rights,the property rights and the exclusive rights. Therefore,the research on the characteristics and contents of the copyright protection of academic journals is not only important in the field of copyright law,but also has a profound impact on the development of academic journals and the timely and accurate exchange of academic achievements.
