摘要
经济全球化引发了国内外环境的各种变化,由此对政府规制劳动关系提出了新的要求。本研究基于国内外环境的变化分析,对政府在劳动关系中的角色和行为、劳动关系规制的方向进行了探讨。研究发现,国内外环境变化增大了集体劳动冲突触发风险,现有规制手段具有滞后性,使得劳工问题成为我国参与国际竞争与合作的门槛。而从制度经济学角度看,政府的角色在于维护劳动者自由劳动的权利和分享劳动成果的权利(即劳权),过往的规制忽视了劳权的保护。最后,论文针对分析结果,给出了中国现阶段劳动关系规制建议。
In the context of economic globalization changes, the government regulation for collective labor relations is facing with some new requirements. Based on the analysis of domestic and international environmental changes, this paper discusses the government's role and behavior in the labor relations and the direction of regulation on labor relations. The study finds that domestic and foreign environmental changes increase the possibilities of collective labor relations conflicts, and existing regulatory measures are hysteretic, which makes the labor issues become China's threshold of participation in international competition and cooperation. From the perspective of institutional economics, the role of government is to protect workers' right of free labor and enjoying their fruits of labors work (i.e.: Labour Rights), but the past regulations ignored the efforts on the protection of labour right. Finally, the paper finally gives some suggestions on the regulation of labor relations according to the analysis.
