摘要
修改前后的两部《消法》都是通过对其调整范围的规定而"间接"告诉人们"消费者"为何物,未对"消费者"的概念的内涵和外延正面作出界定。经济社会的巨大变化带来"消费者"概念的变迁,为使法律规定能满足今日对消费者全面保护的需要,应适度调整这一概念的内涵。"生活消费"满足了对"消费者"这一不确定法律概念内涵开放性的要求,新法对其保留是必要的。界定消费者应在准确理解"生活消费"概念内核的基础上,将适格的经营者作为消费者概念的一个构成要件,并在准确把握新时期对消费客体范围的基础上,判断何者可成为"消费者"。此外,经营者控制范围作为"消费者"构成的一个阻却要件,可将不在经营者控制范围的相对方排除在"消费者"的大门之外。
The Consumer Law doesn't defined the "consumer"before and after the modification, but indirectly tells us who "consumer" is through adjusting the scope. Enormous economic and social changes result in the changes of this definition and the Consumer Law should appropriately adjust the connotation of the concept to meet today's need of the comprehensive protection for the consumer. The concept of "living consumption" meets the requirement of the openness of the uncertain con- notation of "consumer", so its retention in the new law is necessary. The concept of "consumer" should base on the exact defi- nition of "living consumption", take the right operator as one constituent element of the concept of "consumer", determine what may become "consumer" on the basis of accurately grasping the scope of the new era of the consumption object. In addi- tion, the controlling scope of the operator can help us exclude those minors out of this scope from being "consumer".
