摘要
2014年3月至4月间,100多个国家的代表在加拿大的蒙特利尔参加了修改1963年《东京公约》的外交会议,会后形成的立法成果就是该公约的议定书。其新增了管辖权种类、机上安保员等的具体法律制度,反映了国际社会对航空安全立法的新"保护主义"趋势。航空作为自由贸易区航运建设中不可分的一部分,其自身的运营安全性一直处在首要位置。自由贸易区的航空安全立法需准确定位存在的法律问题,并找到有效的法律对策,则应结合负面清单制,分清机上人员的权限,妥善处理管辖权冲突,以此来应对自由贸易区法治建设的新要求。
During March and April of 2014, the delegates of more than 100 countries participated in the diplomatic conference to modify the Tokyo Convention of 1963 in Montreal, Canada. The legislative result of this conference is to form a new proto- col, in which it adds the jurisdiction, IFSOs, reflects the new trend of protectionism in the legislation of international aviation security law. Air transport, as an essential part of the shipping construction in the free trade zone, is always posed in the pri- mary position due to its special trait of security or safety. The legislation of aviation security law in free trade zone should fo- cus on the existing legal problem and find the way to solution. The measures of legal construction of free trade zone include such areas as how to deal with negative list, the powers of peoples in the aircraft and the conflicts of jurisdiction.
