摘要
环境风险交流是环境风险利益相关者之间就环境风险属性和环境风险管理等问题相互交换信息和看法。环境风险交流法律制度对衡平公众环境利益和有效应对环境风险意义深远。我国环境风险交流制度既有环境信息公开的制度基础,也存在风险交流主体地位不平等、信息获取不对称、信任基础不牢固、救济机制不健全等制度障碍。借鉴美国、日本和欧盟等国家和地区在环境风险交流法律制度方面的立法经验,我们可以从创新环境风险交流公共参与制度、健全环境风险交流信息公开制度、加强环境风险交流信用制度建设和完善环境风险交流权利救济制度等方面完善环境风险交流法律制度。
The communication of environmental risk refers to the exchange of environmental risk among stakeholders as for their information and opinions on problems like environmental risk attribution and risk arrangement. The legal system of environmental risk communication plays an important role in balancing the public environmental interests and dealing with environmental risks effectively. China's environmental risk communication has its institutional basis for disclosing environmental information,but it also has system obstacles,such as unequal status of different parties,the asymmetry of obtaining information,unstable trust foundation and imperfection of remedy mechanism. Drawing lessons from the legislative experience of America,Japan,Europe and some other countries or regions,we can improve the legal system of environmental risk communication as follows: innovating public participation,perfecting the information publicity system,strengthening the construction of credit system and improving the relief system of power.
