摘要
社区矫正的重要功能之一是替代监禁刑。通过考察发现,我国社区矫正的监禁刑替代功能并没有得到很好的发挥,域外也是如此。应充分认识刑罚自身的扩张性,将减少监禁人口作为考察社区矫正工作的重要指标,避免社区矫正成为监禁刑的附加手段。
One of the important functions of community corrections is to substitute custody penalty. However, this function has not been performed both in China and outside China. The expansion of penalty should be fully recognized when reducing prison population should be regarded as a key index to evaluate corrections job, and community corrections should be avoided to become an appendage to the custody penalty.
