摘要
过程性信息"一般不公开",规定在《关于做好政府信息依申请公开工作的意见》中。理论和实务界对其理解均出现分野:有认为过程性信息涵盖行政决策或决定过程中的政府信息;亦有解释为处于未完全成熟状态之信息。后者有助于监督"权力在阳光下行使",便利相对人使用政府信息,"非正式、不完整、欠准确因此无使用价值"是过程性信息题中应有之义。而将"尚未产生直接效力"作为判定"过程性"的先行条件,则可以消减信息状态标准过于专业化的不便。此外,必须厘清过程性信息的几种例外公开情形。
There are direct regulations of procedural information protection in provisions on freedom of information.The relevant article is so rough that opinions on this concept are divided. Some people think that procedural information means the government information made or obtained before the administrative decisions, others believes that procedural information referring to government information is still developing and undone. However, the latter not only helps to supervise the government, but also gives people access to government information. There still exist strict limitations in aspects of both content and timing.
