摘要
"宽严相济"刑事政策是我国的基本刑事政策,是党和国家在长期同犯罪作斗争的过程中建立起来的指导思想,具有正确的价值导向和内在的科学根据。我国的刑事立法应当贯彻落实"宽严相济"刑事政策,这对于更好地推进刑事法治的完善和发展及充分保障人权,都具有重要的作用。
＂Temper justice with mercy＂ is a basic criminal policy in China, which has been established by the party and state in the long-term fight against crimes and has the correct value orientation and the inter- nal scientific basis. The criminal legislation of China should implement the criminal policy of ＂temper jus- tice with mercy＂, which is vital for improving the perfection and development of the criminal rule of law. Moreover, it is also good for developing and ensuring the human rights.
