摘要
比例原则作为行政法中的一般原则,在权力行使层面广泛应用。而在权力分配层面的应用未有涉及,包括在国家、社会和个人间的分权,国家内部立法、司法和行政的横向分权,国家内部的中央和地方的纵向分权三个方面。比例原则在分权层面的应用不仅有助于证成比例原则的宪法性效力,而且能稳固宪政框架的基础,并有助于推进国家治理体系的现代化。
Principle of proportion is a basic principle in administrative law,widely applied in the aspect of power executive process. It has not applied in the aspect of power distribution,including the power distribution between nation,society and individuals,the lateral power distribution inside the nation between legislation,administration and justice,and the vertical power distribution inside the nation between the central power and local power. The application of the principle of proportion in power distribution not only can be significant in identifying the constitutional validity that the principle of proportion has,but also sustaining the basis of constitutional structure,and can boost the modernization of national governance system.
