摘要
食品安全问题是近年来全社会普遍关注的热点问题。新中国建立以来,我国的法制建设取得了长足的发展,但是我国食品安全法律体系仍不完善,主要存在法律体系结构上缺乏系统性,法律适用上缺乏协调性,法律体系中标准体系混乱,采用国际标准比例偏低,法律体系中监管体制存在盲点,刑法保护力度不足等问题。完善食品安全法律体系是保障我国人民生命健康权的核心要件,是保障经济又好又快发展的重要条件,是保障基本社会秩序和国家利益的必然要求。要完善我国的食品安全法律体系,就要从健全完善食品安全法律法规,并要确保法律法规之间的有机衔接和协调运行,健全完善食品安全相关配套制度,形成制度合力,加大对违法行为的惩处力度,提高违法成本,加强公众监督和权力监督等。
Nowadays, the food safety has become a social hotspot. Since the foundation of the state, though we have a con- siderable developnent in the present legal construction of our country,the food safety law systems are still imperfect. The main problem of it is the lack of system of the legal structure, the lack of coordination of legal application, the low standard proportion and the blindspot of supervision system in legal system and the weak protection of the criminal law. Perfecting food safety legal system is the core condition to safeguard our people＇s right of life and health, is the important condition to ensure sound and rapid economic development, is the inevitable condition to ensure the essential social order and the interests of the state. To per- fect our country＇s food safety legal system should start from improving food safety laws and regulations first, and ensuring that there is the organic link between laws and regulations and make them run coordinatingly,improving the perfect food safety re- lated system,forming a system of resultant force,increasing penalties for violations of the law,and improving the illegal cost, strengthening the public supervision and power supervision and other aspects.
