摘要
从农地流转相关法律的规范性与完备性、农地流转法律的一致性、农地流转程序3个方面,分析我国农地流转相关法律存在的问题与不足及其可能引致的风险;并提出细化相关法律规定,修订相关法律条款,建立专门的农地流转法律体系,维护农民切身利益及借鉴境外成功经验进行本土化应用等建议。
This paper analyzes the agricultural land transfer-related legal problems and their possible risks from three aspects such as the normativeness, consistency and procedure of agricultural land transfer related laws and practice; and suggests detailing relevant laws and regulations, amending the relevant legal provisions, establishing specific agricultural land transfer legal system, protecting farmers＇ vital interests, learning and drawing lessons from foreign related successful experience for local application, and so forth in China.
