摘要
死刑的逐步废止问题已成为中国刑法理论界与实务界关注的焦点,各种观点层出不穷,为中国死刑的逐步废止问题提供了不少真知灼见。汲取国际上废止死刑的有益经验,并结合中国的现实国情,采取废止和平时期死刑和保留战时死刑的策略不失为一种不错的选择。如今的中国已经基本具备了实施该种模式的各种条件,但仍然需要对"战时"的概念以及相关的具体法规进行调整,以真正落实废止和平时期死刑和保留战时死刑这样的一种死刑废止模式。这不但是全球死刑废止的大势所趋,也是能切实有效地推动中国死刑废止不断向前发展的理性选择。
Nowadays in the worldwide, the development of the Criminal Law of many countries has demonstrated certain homoplasy. Death penalty has been gradually and eventually abolished in more and more countries. The issue of gradually abolishing the death penalty has become the focus in the academia and practical circle of criminal law. Endless viewpoints and approaches have come up with many insights on the abolishment of the death penalty in our country step by step. Drawing from the international helpful experiences and combining with our real national conditions, it may be a good choice to abolish the death penalty in the peacetime and reserve it during the war period. China nowadays has basically been equipped with all sorts＇ prerequisites to adopt to the model. However, it is still necessary to regulate the concept of ＂Wartime＂ and adjust related rules so as to achieve the model of the abolishment of death penalty that is putting an end of the death penalty in the peacetime and reserving it during the war. It is not also a global trend to abolish the death penalty worldwide, but a rational choice to motivate the further development of it effectively.
