摘要
在欠薪型劳资纠纷中,只有恶意欠薪的才有可能构成拒不支付劳动报酬罪。该罪所保障的前提法律关系是劳动法律关系和市场经济秩序,不包括劳务关系、雇佣关系。该罪的犯罪主体是劳动合同的甲方,即负有支付劳动报酬义务的用人单位。该罪的法定从宽处罚情节体现了民事责任和刑罚处罚的衔接。
In the labor disputes of the unpaid wages,only the intentional unpaid wages could constitute the crime of refusing to pay labor remuneration. This crime regulates the legal relationship of labor and market economic order,not include the service relations and employment relations. The subject of this crime is employing unit who is responsible for the payment of labor remuneration. The legal lenient punishment of this crime is related to the convergence between the civil liability and criminal liability.
