摘要
近年来,随着我国互联网的发展及各种网络信息平台的普及和兴起,公民通过网络行使监督权成为一种新兴的方式。网络监督以其特有的时效性、匿名性以及自由性,极大地激发了公民参与社会政治生活的热情。但公民的网络监督权如不加以正确的引导,将导致监督权的滥用,亦不利于国家工作人员隐私权的保护,还会造成两者的冲突。以国家工作人员隐私权的特殊保护为视角,探讨在互联网环境下,如何协调公民网络监督权的行使与国家工作人员隐私权的特殊保护之间的冲突,希冀对健全监督体系、规范监督行为、完善隐私特殊保护立法有所裨益。
In recent years,with the popularization and development of various network information platforms in China,exercising supervision right through the network by the citizens has become a new way.The timeliness,anonymity as well as the freedom of network supervision have inspired citizen＇s great enthusiasm to participate in socio-political life.However,if the right of supervision is out of control and abused,it will be detrimental to the state staff＇s privacy and therefore cause conflicts between them.With the perspective of the special protection of the state staff＇s privacy right,this paper explores how to harmonize the conflict between the exercise of citizen＇s network supervision right and the special protection of national staff＇s privacy right in the Internet environment.Hope this paper will be useful in perfecting the supervision system,standardizing the supervision activities and improving the legislation of special protection of the privacy right.
