摘要
工资的规范应依循法治,而法治构建则应立基于学理。学理上关于工资定义的讨论应突破劳动对价的简单抽象,沿着"劳动力对价说"、"劳动支配对价说"、"劳动关系对价说"的学说演进路径探究工资的本质内涵。以学理为基础评析我国台湾和大陆地区的工资定义法律规定,可将工资定义为用人单位基于劳动关系连续经常地支付给劳动者的工作报酬,其构成项目均具有劳动关系对价的内容。雇主基于劳动关系承担特定情况下劳动不能给付的风险,以保障工资请求权的实现。
Standardization of wages should be in accordance with the rule of law, which is formulated on the basis of legal principles. Theoretical discussion on the definition of wages should transcend the simplification and abstraetion of labor considerations and advance along the evolving theories of " labor force considerations", " labor control considerations", and " labor relationship considerations". Through an analysis of the definition of wages in Taiwan Region and the mainland of China from a perspective of legal principles, wages should be defined as regular remunerations that an employ pays to an employee based on some labor relationship. In addition, all constituents of wages are subject to labor relationship considerations. Employers should be liable for the risks of incomplete delivery in special occasions in order to achieve the remuneration claim right.
