摘要
明代冯梦龙的话本小说《一文钱小隙造奇冤》中涉及13条人命案。表面上看,极其微小的一文钱是引发连锁式社会恶果的起因;而实际上,封建社会"有罪推定"的判案原则才是小说中一系列冤案形成的主因。"有罪推定"的判案原则和"严刑逼供"的刑讯方式使封建社会冤案频发。现今中国,讲求法治,尊重人权,实行"无罪推定",但充分认识"有罪推定"的弊端,对当前的法制建设具有警示意义。
A Small Matter just One Yuan Brings about Odd Injustice,the book was written by Feng Menglong of Ming Dynasty,in which there are 13 murder cases.On the surface,only a very tiny and occasionally happened matter,one Yuan caused a series of bad social events,ripple effects.However,in fact,judgments principle of＂the presumption of guilt＂in feudal society is the real reason for the series of these erroneous cases in the novel.＂The presumption of guilt＂and means of torture to get the confession lead to commonly injustice cases in feudal society.Today,China emphasizes the rule of law,respect for the protection of human rights,the implementation of＂the presumption of innocence＂.However,for the current legal system construction there is cautionary significance to fully understand the drawbacks of＂the presumption of guilt＂.
