摘要
实现参与的有效性是公众参与行政立法的目的和追求的实践价值。行政立法公众参与的有效性集中体现在公众通过参与立法过程对行政立法活动和立法结果产生积极真实的影响。公众在充分表达立法态度和利益主张的基础上,使立法者的决策能够集思广益,提高行政立法质量,实现公众参与所立之行政法规范在内容上更具公正性、正当性和合理性。在行政立法规划、制定和完成的每个阶段社会公众都有效参与其中,对行政立法具体环节发挥积极作用并产生实际影响。创造公众参与行政立法所需要的条件有利于公众参与目标和参与效果的实现。
The purpose of the participation in the process of administrative legislation and its practical value is to pursue the effec- tiveness. The public may positively affect the process of legislation and its results in the participation, which reflect the effective- ness. The public can fully express their attitude and claim their interests. This helps the legislature to draw on collective wisdom and absorb the useful ideas, and enhance the quality of the laws. Accordingly, the content is just, valid and reasonable. In the every stage of the legislative process, including planning, drafting and discussing, the public participation may have positive influence. To create a good condition for the public participation would be helpful to achieve the effectiveness.
