摘要
权利要求保护范围是否清楚是决定实用新型专利授权质量的核心因素之一,其处理得妥当与否将直接影响到整个审查过程的质量和效率。分析了实用新型专利权利要求保护范围清楚问题的法律规定,从具体实例出发,通过从表象到实质的分析,在确保最终授权的权利要求保护范围有效、稳定的前提下,针对看似不清楚的问题,在不同审查阶段提出了不同的处理意见。
