摘要
修法不保持法条序号的稳定,会造成准用规范的法条序号混乱;导致修改的法律与其他相关法律法规联系脱节,损伤法律的缜密性、严肃性;增加法律适用的失误几率和修法、司法成本;妨碍法学文献查阅,有碍法学文化建设。法条序号是法条的基本构成元素,具有法条名称的属性和功能。法条序号应当像法律规范一样得到充分的尊重。保持法条序号稳定的关键,是对增减法条的序号有合理的设置和处理方法,《立法法》应当对此予以规定。
If there is no uniformity of serial numbers in law amendment, it will cause confusions in the serial numbers of the applicable norms. As a result, the amended law will be disjointed with other relative regulations, which will affect the seri- ousness and stability of the legal system. It could also lead to the increase in the number of mistakes in the legal application and the judicial costs. In academic field, it impedes the access to legal literatures. The requirement of the uniformity of serial numbers comes from its fundamental legal principles. The serial numbers of the provisions are basic elements of law, which functions as the name of that provision. The serial numbers should be as fully respected as the legal norms. The key to uniformity of serial numbers is to set up appropriate ways to number the amending regulations, which shall be specified in the Legislation Law.
