摘要
作为一种行政行为，PSC检查中行政自由裁量普遍存在，其影响因素有公约法规及检查官个人原因等。一方面，港口国监督程序、适用的公约、法规和区域性协定中存在行政自由裁量区间，另一方面，检查官的业务水平、个人情绪以及对检查结果的顾虑也是影响行政自由裁量权公正、合理运用的重要因素。
As an administrative act, administrative discretion widely exists in PSC inspection, whose influencing factors include conventions, regulations, personal reasons of PSCO, etc. On one hand, PSC supervision procedures, applicable conventions, regulations and regional agreements exist in the range of administrative discretion, on the other hand, PSCO＇ s professional level, personal mood and concerns of the findings also affect the fair and reasonable application of administrative discretion.
