摘要
依据服务型政府理念,公民是政府的服务对象。服务型政府理念以平衡论为法治理论基础,体现在行政法中就是行政法平等原则。行政法平等原则以行政相对人为本位,即在行政相对人与行政主体地位平等的前提下,强调行政相对人的主体地位。以行政相对人为本位,以行政法平等原则为核心原则,正是建设服务型政府的法治关键。
According to the concept of service-oriented government,citizen is the service obj ect of the government.The idea of service-oriented government takes balance theory as the law theoretical basis, which is reflected in the administrative law is the principle of equality of administrative law.The principle of equality in administrative law is based on the relative man,that is,the main position of the administrative relative person is stressed when the administrative relative person is equal with the administrative subject.The key to the rule of law is to construct service-oriented government,which is based on the relative man standard and the principle of administrative law equality.
