摘要
医务人员的注意义务是判断医务人员在诊疗行为中是否存在过失的标准。我国《侵权行为法》用"当时的医疗水平"作为注意义务的标准,而全科医生与专科医生的区别、不同的医院级别和城乡差异都会对医生的注意义务之标准产生较大影响,因此,对医生的注意义务采用统一的判断标准是不合理的。
Medical staff＇s treatment. The standard in the duty of care is the essential criterion for judging medical negligence in medical Tort Law in our country is ＂the medical standard of the time＂. Since the factors such as the difference between general practitioners and specialists, different hospital levels, the difference be- tween urban and rural areas, etc. may produce great influence on the doctors＇ duty of care, it is not reasonable to adopt the same judging criterion for the doctors＇ duty of care.
