摘要
强制许可本为专利法中的一项制度,主要目的在于平衡专利权人和社会公众之间的利益,是一种非自愿许可。随着社会经济的发展,著作权的产业化、变形复制的承认、功能性作品种类的增多以及著作权财产权地位的提升等都使得著作权领域具备了引入强制许可制度的正当性理由。著作权强制许可制度的引入可以防止著作权垄断、促进著作权贸易的发展、避免网络环境下作品著作权不明朗带来的弊端。在强制许可的具体制度设计上,要尊重作者的精神权利,确立合理的适用范围、适用条件与适用程序。
The compulsory licensing is the law system of the patent law, Its main purpose is to balance the interests between the patentee and the public, it is a involuntary licensing. As the de- velopment of social economy, copyright increasingly industrializing, the recognition of copy deforma- tion, the increasing types of functional works and the property rights in copyright advanced have al- ready set the proper reasons to introducing a compulsory licensing system in copyright law. The im- plementation of the compulsory licensing system in copyright law can prevent copyright monopoly, promoting copyright trade and at the same time avoiding copyright uncertainty caused by the defects of network environment. When designing concretely the compulsory licensing system, we should respect the author＇s spirits, establishing the reasonable applicable scope, suitable condition and appli- cable procedures.
