摘要
由于新型城镇化和农业现代化快速推进与配套的土地、户籍制度改革滞后之间的矛盾不断加剧,农村土地股份合作经济组织因股东资格界定问题引发了越来越多的收益分配纠纷与冲突。作为推进农村土地股份合作制进程中最关键和最困难的问题——股东资格界定,关乎机会公平和利益公平,需要在厘清不同形式组织对应的股东资格称谓、获取股东资格所必须的入股要素的基础上,同时确定股东资格界定标准和界定主体。
Because the contradictions between the rapid advance of new urbanization and the comparatively lagged reform of household registration system are continuously intensified,land stock cooperative economic or-ganization which is the implementation vector of the rural land joint -stock cooperation system is facing more and more dispute and conflict about rural collective income distribution caused by the definition of shareholder qualification.As the critical and the most difficult problem to promote rural land joint -stock cooperation system process,the definition of shareholder qualification is closely related to opportunity equity and benefit equity,and the definition standards and subject of shareholder qualification must be determined at the same time on the ba-sis of clarifying both the appellation of shareholder qualification corresponding with the different organization forms and the shares elements that can be used to acquire the shareholder’s qualification.
