摘要
法院的庭审直播是指法院在法庭审判的同时通过广播、电视或网络等途径对庭审过程进行的图文、音频、视频播放。庭审直播是司法公开的需求与现代科学技术相结合的产物。庭审直播是有利有弊的。就当下中国而言,庭审直播的价值主要表现为有助于增强司法的透明度,提升司法的公信力,维护司法公正,遏止司法腐败,改变庭审虚化的现状,促进司法判例制度的建立等。目前,中国法院的庭审直播存在着地区发展不太平衡、直播体系不很规范、直播技术不够专业、直播内容不甚完整等问题,因此就要健全庭审直播的体系,完善庭审直播的规则,提升庭审直播的水准,加强庭审直播的实效。
Courtroom live broadcasting refers to the graphic, audio and video live broadcasting of the trial process that the court makes through radio, television and internet. Courtroom live broadcasting is the joint product of open justice with modem science and technology with pros and cons for it. The values of courtroom live broadcasting are to enhance the trans- parency and credibility of the courts, to maintain the judicial justice, to curb the judicial corruption, to improve the func- tions of the trial, and to improve the system of judicial precedents. However, there are some problems in the courtroom live broadcastings in China now, such as the unbalanced regional developments, the non - standardized broadcasting systems, the unprofessional broadcasting technologies, and the un - authenticity of broadcasting contents. The courts should improve and modify the courtroom live broadcasting in the respects of systems, contents, methods, technologies, and real effective- ness.
