摘要
21世纪的深海将成为自然资源的战略开发基地,我国对该领域的法律规范还相当薄弱,在深海底矿产资源勘探开发许可制度中还存在监管机构分立、许可类型单一、许可条件不完善和后续监督隐患等问题。澳大利亚、库克群岛等国的相关立法对深海底矿产资源的勘探开发许可制度进行了较为合理的构建,他们所遵循的一般规律,对我国相关制度的确立和完善具有借鉴意义。
In the 21st century, deep sea will be the strategic base of natural resources. However, China's legislation in this field is inadequate, with a number of problems in the licensing system of the deep-sea miner- al exploration and exploitation, such as separated regulators, monotony of licensing types, flawed licensing conditions and defective follow-up supervision system. Countries like Australia, the Cook Islands have made laws to construct a reasonable licensing system for deep-sea mineral exploration and exploitation. The rules they followed can be borrowed to establish and improve China's licensing system of deep seabed minerals.
