摘要
保健食品是介于"食品"和"药品"之间的一类特殊食品。保健食品不仅要求具备一般食品的安全性,还必须具备声称的保健功能,这就进一步增加了保健食品监管的难度。食品安全立法应当如何确立对保健食品的有效监管制度,是启动食品安全法修订工作以来的一个重点难点问题。研究日本《健康增进法》等确立的保健食品分类监管制度,可以为解决我国保健食品的监管难题提供有益的参考和借鉴。
Health food is a special kind of foods between "foods and "drugs" . Health food is requested to have not only general food safety but also the claimed health promotion function, which further increases the difficulty of health food supervision. How to establish an effective health food regulatory system is an important and difficult issue for the revision of Food Safety Law. A comparative study on Japan' s classification supervision system, established by Health Promotion Law, can provide a useful reference for solving our health food regulatory problems.
