摘要
在生态文明和美丽中国建设的背景下,在当前我国环境纠纷大量发生而司法解决机制不畅的情况下,环境审判机构进行改革即实现环境审判机构的专门化是必然的选择。但对于环境审判机构的专门化以何种形式来体现,在理论界还没有达成共识,还存在多种方案。实践来看,各地选择的是成立不同形式的环保法庭。从我国法治建设水平和司法体制改革进程来看,环境审判机构专门化有一个从专门法庭走向专门法院的过程。综合考量各种因素,现阶段环境审判机构专门化最为合适的是推进环保审判庭的建设和运行。环境审判机构专门化的理想形态是建立环境法院。
Under the background of construction of ecological civilization and the beauty of China, the condition that judicial settlement mechanism can＇t settle more and more environmental disputes occur generally, so it is the inevitable choice to realize the reform of environmental judicial organizations namely specialization of environmental trial institutions. But for the form of specialization of environmental trial institutions, there are many alternatives in the theoretical circle. In practice, the different forms of environmental courts have been set up. From the level of construction of the rule of law and the process of judicial system reform, specialization of environmental trial institutions in China has undergone a process of from special courts to specialized courts. By considering various factors, it is the most appropriate to promote the construction and operation of environmental tribunal about specialization of environmental trial institutions in China. The ideal form of specialization is to establish environmental court.
