摘要
《黄帝四经》作为汉初黄老学派的经典,对当时政治产生了重要影响。对此学界多有探讨,但就《黄帝四经》中的司法思想及其对后世司法文化的影响,学界罕有探索。本文只从司法思想的视角切入,以考察《黄帝四经》中的司法思想,认为阴阳刑德论是其司法思想的核心,司法公正论与司法道德论是其两个侧面。其中的阴阳刑德论对后世的司法思想与司法制度均产生了深刻影响,并经汉儒董仲舒等人之手完成了从理论形态到制度形态的过渡;这就是秋冬行刑制度的历代传承（自汉至清）。
＂Four Classics of Huangdi＂ as a classic early Han Huang - Lao school of politics at that time had a significant impact. This article only cut from the perspective of judicial thinking to examine ＂Four Classics of Huangdi＂ Judicial idea that Yin and Yang Punishment Ethics is the core Of its judicial thinking on justice and judicial ethics on its two sides. One of the Yin and Yang Punishment Ethics thoughts on future judicial and judicial systems are a profound impact, and by the hand of Confucian Dong Zhongshu, who completed the transition from theory to institutional shape form.
