摘要
党的十八届四中全会提出要健全依法决策机制,建立重大决策终身责任追究制度及倒查机制,既是法治政府建设的一项基本要求,同时也是责任政府建设的必然选择。其实质则是决策责任追究的时效问题。然而,在推进依法治国的进程中,要建立这样一项新的制度并使其依法有效运行却面临着一系列的问题,如决策责任体系的不完善、制度的碎片化以及法律追诉时效问题等等。解决这些问题的途径或许就在于加强顶层设计,在全国一盘棋的基础上完善决策责任体系,实现各种制度的有机整合与协调,并从法律层面上解决终身追责与追诉时效之间的矛盾。
It was proposed to improve the mechanism of decision-making by law and establish the life-long responsibility system and down-search mechanism for decision-making in the fourth Plenary Session of the 18 th Communist party of China central Committee.It is not only the fundamental requirement of the law-based government building,but also the inevitable choice for responsible government building.The essence of the problem is the timeliness of decision-making accountability.However,it faces a number of problems to establish such a new system while promoting the rule of law,such as inadequate decision-making responsibility system,the fragmented system and the legal statute of limitations issues and so on.Perhaps the ways to solve these problems are to strengthen top-level design,develop the decision-making responsibility system based whole country,achieve organic integration and coordination of various systems,and resolve conflict between life-long accountability and the statute of limitations in the law.
