摘要
从创作背景看,只有将卡夫卡所处的社会文化环境、独特的思维方式、法律经历和具体的促动事件整合一体,将宏观解释和微观分析有机结合,才能真正看透《审判》背后的审判,以及实在法背后的"文学法"。从内容主旨看,《审判》是卡夫卡苦心孤诣打造的"穿透"法律之作。通过对法律本质的文学拷问,卡夫卡内心认同的文学律法成为超越现实法律的神秘源代码。就基本特征而言,卡夫卡文学律法范型独特、原则明确、结构开放、诠释多元。在《审判》中,文学的伦理裁判才是最接近真理的真正"审判"。未来的"文学法理学"应当在"法律与文学"基础上实现新的超越。
We can really see through literature law behind positive law and another trial behind The Trial by the method of macroscopic interpretation and microscopic analysis to integrate Kafka＇s social cultural environment, unique way of thinking, legal experience and activation of specific events in the background. Kafka tried to penetrate the essence of law in The Trial from the point of theme. Through a literary inquiry into the nature of law, literature law that is identified by Kafka becomes the mysterious source code beyond the positive law. In terms of its basic features, Kafka＇s literary law has its unique paradigm, clear principle, open structure and pluralistic interpretation. In The Trial, literature ethics is the real ＂trial＂ as closer to the truth.Literary jurisprudence in the future should go beyond the movement of ＂law and literature＂.
