摘要
在现代伦理政治的基本话语体系中,正义概念成为首出概念,它以"理性"为基础,以"自由"和"平等"为两翼。先秦儒家思想本质上是仁型的,与"理性""平等""自由"三个理念都是相悖的,现代转型十分困难。先秦道家思想本质上是智型的,与"理性""平等""自由"三个理念存在着相通契的可能,更容易实现现代转型。而在先秦道家思想内部,黄老道家与这三个现代理念相通契的可能性最大,因而实现现代转型最容易。
In the basic discourse system of the modem ethical politics "justice" has become the top concept, taking "rationality" as it base and "freedom" and "equality" as its two wings. The pre - Qin Confucius Thought was in its essence the benevolent type, paradoxical to the three concepts of "rationali- ty", "equality" and "freedom", making it very difficult to do its modern transformation. The pre -Qin Tao Thought was essentially the wisdom type, making it possible to tally with the three concepts of "rationality", "equality" and "freedom" and easy to do the transformation. In addition, within the pre- Qin thought, the Huang Lao Taoist is more possible to tally with these modem concepts, making it the easiest to do the modem transformation.
