摘要
"丝绸之路"金融法律合作必须在全球性国际金融组织和相关法规的调整下进行,包括世界贸易组织、国际货币基金组织、巴塞尔银行监管委员会、世界银行等,同时要受相关区域性金融及法律合作组织的规范。"丝绸之路"金融法律合作机制主要包括市场准入法律机制、货币流通法律合作机制、外汇管制法律合作机制、投资开发法律合作机制、证券市场法律合作机制和司法裁判法律合作机制,需要正确处理国内法和全球性金融法律的合作问题、国内法与区域性金融法律的合作问题。
Financial and legal cooperation in ＂Silk Road＂ should be carried out in the adjustment of global financial organization and related law and regulation,such as WTO,IMF,Basel Committee on Banking Supervision and the World Bank;it should also be standardized by related regional financial and legal cooperative organizations. The financial and legal cooperation mechanism in＂Silk Road＂includes the mechanism of market access,legal cooperation in currency circulation,legal cooperation in foreign exchange governance,legal cooperation in investment and development,legal cooperation in securities market and legal cooperation in judicial adjudication. We should correctly handle the problems in cooperation of domestic laws and global financial laws,and cooperation of domestic laws and regional financial laws.
