摘要
根据世界知识产权组织通过的《马拉喀什条约》,缔约方有义务在国内法中提供无障碍格式版的制作、传播、公共获取和跨境交换的版权限制与例外规则。实施方面,缔约方遵守有效实施和适当实施原则,保证实施透明度。我国有在遵守三步测试法的前提下适当实施《马拉喀什条约》的义务。我国图书馆应推动相关立法,从管理机制、资源建设、服务形式、共享机制等方面进行创新,利用实施《马拉喀什条约》的契机,切实加强我国图书馆无障碍服务建设。
According to the ＂Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually impaired or otherwise print disabled（Marrakesh VIP Treaty）＂which administrated by WIPO, contracting parties shall provide for limitations or the right of reproduction, the right of distribution, the right of making available and the cross-border exchange of accessible format copies in their national copyright laws. In order to make sure the enforcement of the minimum obligations of WIPO ＂Marrakesh VIP Treaty＂, contracting parties should adhere to the principle of effective and appropriate implementation, and ensure the transparency of the enforcement. As a developing country,China should implement the obligations of ＂Marrakesh VIP Treaty＂ properly complying with the three-step test principle. Chinese library community should promote the advance of the relevant legislation in China, and strengthen the libraries＇ accessibility services innovation on the management mechanism, resource construction, service pattern and sharing mechanism.
