摘要
杨婷婷高考试卷"掉包"案中,法院的判决思路呈现出豁免公开事由定位模糊、裁判依据合法性审查缺位,以及审查方式纯粹形式化的样态。与国家秘密相比,如高考试卷这类所谓工作秘密信息,在保密时限、范围、事项上表现出更甚前者的保密性。工作秘密在实践中广泛存在于各类国务院工作部门的密级规定中,以"不属于国家秘密,且不宜公开"的表述形式出现;应当将此类信息置于《政府信息公开条例》设定的解释框架中,重新考量并实现有选择、有限制的不予公开。由此引申出关注法律概念的无形变迁,是正确适用规范的重要前提。
In the case of YANG Ting-ting, when judge considers the tion papers could not be disclosed, there are three main problems in his j college entrance examina- udgment namely ： doubtful exemption, legality of rules and purely formal examination. Comparing with state secrets, the workrelated secrets like college entrance examination papers have even higher confidentiality in time, scope and matter. Work-related secrets are widespread in various departments of the State＇s security classification regulations, they are not state secrets but could not be disclosed. When applying this exemption, such information should be placed in the explanatory framework that set by Regulation on the Disclosure of Government Information to finally determine they should be disclosed or not. Thus raising the concern about the invisible changes for the correct application of norms.
