摘要
藏族"说事"(■)以"和合"观念为依托,奉行实用主义、人本主义价值观;肇自西方的刑事和解则深受"理性主义"观照,倡导恢复正义与平衡理念。两者在制度设计、功能取向上的类似不能掩盖其背后的法文化蕴涵差异。但在藏区这一特殊地理文化空间内,刑事和解与"说事"在价值蕴涵上具有可沟通性与缓解基层司法困境、提高犯罪治理水平的互补性,两者具备整合的制度与观念基础。
The traditional Tibetan mediation mechanism( wa-vdum) is deemed as the legal culture heritage in Tibetan society,which is based on the "harmonious and syncretic idea",seeking for the values of pragmatism and humanism. The victim-offender-reconciliation( VOR) mechanism,originated from West,however,advocates the values of justice and balance restoration under the guidance of rationalism. The two mechanisms are similar in the design of institution and function,but different in the cultural background. Whereas,in Tibetan area,a special geographical and cultural space,VOR and the Tibetan mediation are negotiable in the essence of legal culture and are complementary in alleviating the dilemma the criminal justice is facing in Tibetan pastoral areas,which could be used to put the respective advantages into institutional integration.
