摘要
资本全球化大量流动的背景下,对国际投资协调机制的需要日益凸显。作为对其多边机制尝试受挫的替代,双边投资协定成为调节与规范对外直接投资的主要手段,在国际投资协调中占据重要地位,中国亦成为缔结双边投资协定最多的国家之一。作为协定中承诺将如何被实现的程序性保障,争端解决机制的形式选择被视为双边投资协定研究的重要议题。由于对东道国为缔结协定所需付出的国家间缔约成本重视不够、对国家自主性与国家异质性的忽略,既有的研究在一些整体推断上可能是误导性的,且对市场规模较大的东道国或缺乏解释力。在修正既有研究的基础上,作者以1982年至2013年中国签订过的134份双边投资协定为样本进行了计量研究,并进一步区分了中国作为东道国和母国的情况。作为东道国,中国能在一定程度上缓解母国的授权压力;作为母国,中国在"走出去"的过程中愈发注重保护海外投资利益,但并未运用自己的经济权力来使得他国接受更多国际授权的争端解决机制。研究结果对理解中国外交的特质与在此议题上的行为特征是启示性的。
In the context of global capital flows,the need for international coordination mechanism for investment has become increasingly prominent.As an alternative option for the frustrated attempt to create a multilateral coordination mechanism,the bilateral investment treaties(BITs) play an important role in the regulation and specification of foreign direct investment(FDI).Also,China has become one of the largest BITs signers these days.As the procedural guarantee of the commitments consisting in the treaties,the institutional choice of dispute settlement mechanism(DSM) in BITs is regarded as a critical issue.Nevertheless,existing studies may be misleading in some of their inferences,and may fail to be applied to some countries which have relatively large market size.This is due to their inadequate attention on the contracting costs of host countries and the ignorance of state autonomy and the inter-state heterogeneity.We carry out a quantitative study based on China's 134 BITs signed from1982 to 2013;we also consider whether China is a host or home country.As a host country,China can cope with the delegation stress from the home country to a certain extent;as a home country,China is paying increasingly close attention to the protection of its overseas investment interests in its 'going-out' strategy.However,there is no statistical evidence to demonstrate China's utilization of its economic power to compel others to adopt higher delegated dispute settlement mechanism in BITs.These findings provide better understanding of behavior characteristics of China's BITs signing as well as the traits of China's diplomacy.
