摘要
以社会学视角来解释土地流转的影响机制,通过嵌入性的产权社会学视角,呈现土地流转镶嵌在国家、市场与地方社会的过程。虽然经济学、法学的研究强调市场制度和有关土地产权的法律是影响当前土地流转的主要因素,但单单依靠国家的法律制度及市场机制来讨论土地流转,脱离产权运作的社会环境的分析是不完全的,唯有加入地方制度分析,考虑国家、市场、地方性制度的互动关系和影响过程,才能更清晰地解释影响土地流转的因素。
This paper explains the influence of the land transfer mechanism from the sociological perspective, bases on sociology perspective of embedding property fights, and presents the process of land transfer applying in the country, market and local society. Al- though the economic and legal researches emphasize thai the msa＇ket system and the laws of land property fights are the main influencing factors for the current land transfer, this paper argues that relying on the country＇s legal system and market mechanism and breaking away from the social environment of property fights are not enough for land transfer. Through joining the l^al institutional analysis, considering the interaction and influence of country, market, local system process, we can explain the influencing factors of land transfer more clearly.
