摘要
近年来,我国宪法学研究上的一个重要变化,是宪法文本主义的影响不断扩大。在本质上,宪法文本主义是文本主义在宪法解释学上的一种体现。其主要强调:尊重宪法;以宪法为中心;探求宪法文本的明显含义;排斥其他因素;反对文字主义与文本虚无主义等。公允地说,宪法文本主义有助于宪法学的发展,但其缺陷也较明显。对于宪法文本主义的主张、实质、认定标准以及其内在的缺陷进行反思,将有助于提高人们对于宪法学方法的整体认识。
In recent years,studies on constitutional jurisprudence have endured a major change as the influence of the constitutional textualism grows rapidly. The constitutional textualism,in essence,is the texturalism in constitutional interpretation,which focuses on respecting the constitution; centering on the constitution;exploring the explicit meaning of the constitutional text; excluding other factors and opposing the literalism and nihilism. Objectively speaking,the constitutional textualism is conducive to development of constitutional jurisprudence,but its defect is also evident. Thus,a reflection on the constitutional textualism of its argument,essence,criterion and inner defects will boost an overall understanding of the constitutional methodology.
