摘要
以全国27个省份法院裁判文书作为实证研究样本,运用统计学分析方法对我国非法行医罪的量刑进行分析,观测我国非法行医罪量刑的基本特征;对影响非法行医罪量刑的诸多因素进行概括总结,探索基于不同因素在量刑上的差异及对量刑的影响。发现当前我国非法行医罪量刑上值得推广的经验和需要改进的问题,期翼为我国非法行医罪的理论繁荣提供经验基础,为司法人员量刑提供参考。
We find many Verdicts about illegal practice medicine crime from 27 different provinces in our country as empirical research subjects, Observe the sentencing characteristics of illegal practice medicine crime through statistical analysis. summary sentencing factors,explore the differences in sentencing and the influence of different factors on sentencing, find worthy experience and problems need to improve on sentencing of illegal practice medicine. We hope to provide empirical basis for theoretical study and sentencing references for the judicial officer.
