摘要
我国少数民族法律研究多数涉及法律语言的道德性指标,对厘清语言的不可通约性结构缺乏应有的探索意识。纵观19世纪法学成果,围绕语言与法律的语义思辨一直没有停止,那时候,人们经历的是一个满怀信心看待法律确定性的时代,20世纪后半期,却拉开了不确定性的研究帷幕。对现代实证主义法律思潮的语言形式抨击提出了质疑,主张树立后现代主义法律观,视少数民族法律语言为充满弹性、允许意旨模糊的流变组织,通过放弃语言通约性结构的"唯一解"立场,促使法律概念始终处于不止行的发展过程,用以适应多义性时代的法律价值判断。
The research on ethic laws in China is mainly focused on the morality of law languages,neglecting the exploration of the incommensurable structure of law languages. We found that there ran through the semantic speculation concerning law languages after taking a panoramic view of the achievements in law fields in the 19 th century,a time when people considered laws as something certain with confidence. However,in the second half of 20 th century,the study of the uncertainty of law languages began emerging. It is going to criticize modern positivism law trend, and advocate the post-modern notions,which holds the view that ethnic law languages are full of elasticity,and that they allow the fuzziness of meanings. By abandoning the idea that languages are commensurable,we can make the notions of laws stay in the process of ever-changing,thus adapting to the value judgment in the era of polysemy.
