摘要
我国2007年以来的试点已证明,未形成起码的法律体系,环境污染责任保险事业的建立必然陷入"叫好不叫座"的僵局。2014年修订通过的《环境保护法》仅新增了鼓励投保条款,未能打破上述僵局,但已宣告我国环境污染责任保险立法新阶段的开始。未来应建立三个板块组成的环境污染责任保险全国性立法的体系。当务之急是尽快研究制定《环境污染责任保险法》,并在《大气污染防治法》等环境单行法修改中适时规定强制投保条款。
It was proved by China's pilot practice from 2007, that creation of environmental liability insurance, without the support of minimum legal system basis, got into trouble of a deadlock named "good film but small audience". Announce- ment of the encouragement of insuring environmental liability policy by the State, which is the only related revising of the 2014 Amendment of the Environmental Protection Act (EPA), cannot break the deadlock. However, it declared the entry into the post--EPA era of legislation for environmental liability insurance. The future legal system of environmental liability insurance, exploring by the law makers through breaking up traditional mind and being bold in making innovation, should compose by at least three sections of national wide legislations. The urgent priority of the establishment of this legal system is the formulation of Environmental Liability Insurance Act. While the drafting Amendment of the Act on Prevention and Control Atmosphere Pollution ought to add to a compulsory insurance provision.
