摘要
进入21世纪,中国特色社会主义事业发展到新阶段,不断推动中国当代法哲学研究范式向前发展,权利本位范式正在逐步向权利——义务平衡范式转化与演变。权利是权利本位范式的基石范畴,法学研究范式的发展必然带来权利理念的变迁,法平衡范式修正了权利预设,进而推动权利逻辑从主体性转向主体间性,权利方法论立场从"原子论"转向"关系论",权利本质从斗争性转向合作性。
Since it entered into the 21 st century, the cause of socialism with Chinese characteristics has developed into a new stage, which has propelled the research paradigm of contemporary legal philosophy of China forward. The paradigm of standard of right is gradually changing and evolving to right-duty balance paradigm. Right is the cornerstone of the paradigm of standard of right. The development of legal research paradigm brings about the changes of the right concept inevitably. The legal balance paradigm has revised the right presupposition and then promotes the transformation of the right logic from subjectivity to intersubjectivity, the right methodology stand from atomism to relationism, the nature of the right from belligerence to cooperativity.
